1. Acceptance of Terms
By accessing or using this website (the "Site") or any materials we make available here, you agree to these Terms of Service ("Terms") of Thomsens.net LLC ("Company", "we", "us"). If you do not agree, do not use the Site.

3. Software and EULA
Software downloads referenced on the Site are licensed, not sold. Software is governed by the end‑user license agreement (EULA) presented during installation or provided with the Software. If these Terms conflict with a Software EULA, the EULA controls for that Software.
4. Trials and Beta/Preview
Trial, evaluation, or beta/preview Software is provided "as is", may be modified, suspended, or withdrawn at any time, and is excluded from any service levels or support commitments unless we state otherwise in writing.
5. Intellectual Property
The Site, the Software, and all related content, trademarks, and documentation are the property of Thomsens.net LLC or its licensors and are protected by law. No rights are granted except as expressly stated in these Terms or an applicable EULA.
6. Acceptable Use
You agree you will not:
- Access or use the Site or Software in violation of any law or rights of others;
- Interfere with or disrupt the Site or attempt to gain unauthorized access to any service, data, or account;
- Reverse engineer, decompile, or attempt to derive source code from the Software except to the extent permitted by law;
- Scrape, crawl, or harvest content except as permitted by our robots.txt or by prior written permission;
- Remove or alter any proprietary notices on the Site or Software.
7. Third‑Party Components
Our Software may include or be distributed with third‑party components that are licensed under separate terms. Third‑party notices and full license texts for our products are published at Third‑Party Notices and are incorporated by reference. If a third‑party license conflicts with these Terms for that component, the third‑party license will control for that component.
- Qt (commercial license): Our products use Qt under a commercial license from The Qt Company. © The Qt Company Ltd and other contributors. Qt may itself include components under additional third‑party licenses; where applicable to our builds, those notices are incorporated into this page.
- NVIDIA CUDA Toolkit: Our products may statically or dynamically link the NVIDIA CUDA runtime and related CUDA Toolkit libraries (component set varies by product and platform). Redistribution and use of CUDA components are subject to the NVIDIA CUDA Toolkit End User License Agreement (EULA). See Third‑Party Notices for details and trademark attributions. On platforms where a build relies on system‑installed CUDA components and does not redistribute them, these CUDA notices apply to the dependency but we do not redistribute those binaries.
- SQLite: Some products embed SQLite for local storage. The SQLite source code is in the public domain. See Third‑Party Notices for the public‑domain statement and trademark attribution.
- ExprTk: Some products embed the ExprTk expression parsing library by Arash Partow. ExprTk is licensed under the MIT License. See Third‑Party Notices for the full license text and attribution.
- OpenSSL: Our products use OpenSSL 3.x, and some platform builds may include OpenSSL 1.1.1w. When we redistribute OpenSSL 3.x, it is provided under the Apache License 2.0 (see license text below). When we redistribute OpenSSL 1.1.1w, it is provided under the OpenSSL and SSLeay licenses and includes required attributions to the OpenSSL Project and Eric Young (see license texts below). On platforms where a build relies on operating‑system cryptography and does not redistribute OpenSSL, these OpenSSL notices do not apply to that build.

8. Disclaimers
THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant the Site or content will be error‑free, accurate, complete, current, or uninterrupted.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THOMSENS.NET BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNTS YOU PAID TO US (IF ANY) FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. These Terms are governed by the laws of the State of North Carolina, USA. You submit to the exclusive jurisdiction of the state and federal courts located in North Carolina, USA for disputes arising from or relating to the Site or these Terms.
